Welcome to Denita Necole Art (“we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of denitanecoleart.com (the “Site”), operated through Shopify, including any purchases made through the Site.
By visiting our Site and/or purchasing something from us, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
Use of Site
You may use our site for lawful purposes only. You agree not to use our site in any way that violates any applicable laws or regulations.
You must be at least 18 years old to use this Site or make a purchase.
You may not use our products or Site for any illegal or unauthorized purpose, nor may you violate any laws in your jurisdiction, including copyright or trademark laws.
A breach of any of these Terms will result in immediate termination of your access to our services.
Intellectual Property and Artwork Rights
All content on this site, including all artwork, images, designs, text, graphics, logos, and content on this Site are the exclusive property of Denita Necole Art and are protected by copyright, trademark, and intellectual property laws.
Purchasing a product does not transfer copyright or reproduction rights. Artwork is sold for personal use only unless otherwise stated in a separate written licensing agreement.
You may not reproduce, distribute, resell, modify, or commercially exploit any artwork or content without prior written permission.
Products, Pricing and Availability
All products are subject to availability. We reserve the right to limit quantities, discontinue products, or modify product descriptions and pricing at any time without notice.
Prices are listed in U.S. dollars unless otherwise stated and are subject to change without notice.
We make every effort to display artwork colors accurately; however, we cannot guarantee color accuracy due to differences in monitor displays.
Orders and Payments
All orders are subject to acceptance and availability. We reserve the right to refuse any order. Payment must be received before orders are processed.
We reserve the right to refuse or cancel any order at our discretion, including suspected fraud or unauthorized transactions.
If an order is canceled after payment has been processed, a refund will be issued to the original payment method.
Payments are processed securely through Shopify’s payment providers. We do not store your full payment information.
Shipping and Delivery
Shipping times are estimates and not guaranteed. Delays may occur due to carriers, weather, or circumstances beyond our control.
Once an order has shipped, we are not responsible for lost, stolen, or delayed packages. Please contact the carrier directly for delivery issues.
Any customs duties or taxes for international orders are the responsibility of the customer.
Some products are fulfilled by a third-party print partner, so understand that production times may vary.
Returns, Refunds and Exchanges
Because many items are art prints and made-to-order, all sales are final unless otherwise stated.
Refunds or replacements may be issued at our discretion for items that arrive damaged or defective. You must contact us within 7 days of delivery with photographic evidence.
We do not accept returns for buyer’s remorse, incorrect sizing, or color variation due to screen differences.
Accuracy of Information
We are not responsible if information on the Site is inaccurate, incomplete, or not current. The content is provided for general information only and should not be relied upon without consulting more accurate sources.
Disclaimer of Warranties
The Site and all products and services are provided on an “as is” and “as available” basis, without warranties of any kind, express or implied.
We do not guarantee uninterrupted, secure, or error-free service.
Limitation of Liability
To the fullest extent permitted by law, Denita Necole Art shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Site or products.
Our total liability shall not exceed the amount paid for the product giving rise to the claim.

By using the Site or contacting us electronically, you consent to receive communications electronically and agree that such communications satisfy legal writing requirements.
